    Terms of Service

    1. Introduction

    These Terms of Service (“Terms”) govern the use of this website and the provision of services by Dominik Leszczyński (the “Contractor”). By using this website or entering into an agreement for services, you (the “Client”) acknowledge and accept these Terms.

    2. Scope of Services

    The Contractor provides remote implementation services, including but not limited to:

    All services are delivered remotely. No on-site services are provided.

    3. Client Types

    Services are offered to both:

    Certain statutory consumer rights may apply where required by applicable law.

    4. Contract Formation

    1. Contacting the Contractor does not constitute entering into a contract.
    2. A binding contract is formed only once service scope, pricing, and conditions are agreed upon through email correspondence.
    3. Email correspondence constitutes written agreement for contractual purposes.

    5. Pricing and Payments

    1. Pricing is agreed individually during email correspondence and depends on service scope and complexity.

    2. Payment terms:

      • New clients: 50% upfront payment before work begins.
      • Returning clients (with three or more completed contracts): payment after completion, unless agreed otherwise.

    3. Accepted payment methods include:

      • Bank transfer
      • PayPal
      • Other client-preferred methods, provided they comply with EU regulations

    6. Performance and Cooperation

    1. The Client agrees to provide timely access to all information, systems, and materials necessary for service delivery.
    2. The Contractor is not responsible for delays or failures caused by missing, incorrect, or late information from the Client.

    7. Liability and Warranty Disclaimer

    1. Services are provided with professional care but without guarantees of specific results.

    2. The Contractor’s total liability, regardless of legal basis, is limited to the total price paid for the specific service.

    3. The Contractor is not responsible for:

      • Failures or outages of third-party services (e.g. hosting providers, cloud platforms, ISPs)
      • Issues resulting from Client-side configuration changes, misuse, or unauthorized modifications

    8. Intellectual Property Rights

    1. Upon full payment, ownership of the results of the service is transferred to the Client.
    2. If the Client refuses or fails to accept ownership rights, the Contractor retains ownership.
    3. The Contractor retains the right to reuse general knowledge, experience, and non-confidential techniques gained during service delivery.

    9. Portfolio and References

    1. The Contractor may display non-confidential work or general descriptions of completed projects on personal websites or professional profiles.
    2. The Client may revoke this permission at any time, without providing a reason. Upon revocation, the Contractor will remove such references within a reasonable time.

    10. Termination

    1. Either party may terminate the contract without notice if continuing cooperation poses legal, regulatory, or compliance risks.

    2. Upon termination:

      • Completed work is transferred to the Client
      • The Contractor retains a copy of the completed work
      • Outstanding invoices remain payable

    11. Data Retention

    1. The Contractor retains:

      • Email correspondence and included data
      • Payment-related information used to complete the transaction

    2. Unpaid invoices are retained for 5 years, in accordance with Polish archiving and accounting regulations.

    12. Governing Law and Dispute Resolution

    1. These Terms and any contracts formed under them are governed by Polish law or applicable European Union law, depending on the Client’s status and legal requirements.
    2. Parties agree to attempt amicable resolution through written communication before initiating formal legal proceedings.
    3. Court proceedings are a last resort and shall take place before a competent court under applicable law.
